How The GOP's Shutdown Over Obamacare Fell Short

Remember how that fight over the budget was all about Obamacare?

Seems like ancient history now, but House Republicans ostensibly shut down the government 17 days ago, demanding first a defunding, and, when that failed, a year's delay in the health law.

When it became clear that President Obama and Senate Democrats weren't going to yield to demands to stop or slow implementation of the administration's signature legislative achievement, Republicans looked for smaller changes.

They floated the idea of killing or delaying an unpopular tax on medical devices. Many Senate Democrats joined Republicans in a nonbinding vote of displeasure on the tax earlier this year.

The Republicans also looked to take away health insurance contributions for congressional and executive branch staffers. And they proposed to delay a temporary $63 annual per-person health insurance tax intended to build a fund to help pay for high-cost cases.

None of those things ended up in the final bill that reopened the federal government and raised the debt ceiling Wednesday night.

So what did?

Well, there was a little language related to the health law. It requires that the Secretary of Health and Human Services "certify to the Congress that the Exchanges verify" that individuals who get subsidies for premiums and cost-sharing are, in fact, eligible. And that the secretary "shall submit a report to the Congress that details the procedures employed by the American Health Benefit Exchanges to verify eligibility for credit and cost-sharing."

Sounds like a big deal? Not really. It so happens that the much-maligned "data hub" that's part of the health exchange already links to the IRS to verify income eligibility. So, basically, the law requires HHS Secretary Sebelius to write a letter explaining what the department is already doing.

But it's not just that the Republicans failed to make any changes to the health law in their 16-day tirade against the government. News coverage of the shutdown and potential default crowded out stories about the very rocky rollout of the health exchanges themselves.

Paralyzed porn mogul Larry Flynt wants attacker's life spared

Los Angeles (AFP) - Porn mogul Larry Flynt urged US authorities Thursday to spare the life of a man sentenced to death for shooting him 35 years ago, leaving him paralyzed and wheelchair-bound.

Joseph Paul Franklin is due to be executed next month after being convicted over the March 1978 attack on Flynt outside a Georgia courthouse, where he was fighting obscenity charges.

In an opinion column for industry journal The Hollywood Reporter, the 70-year-old said he would like to physically hurt Franklin the way he had been damaged by being shot, but did not want him dead.

"In all the years since the shooting, I have never come face-to-face with Franklin," Flynt wrote.

"I would love an hour in a room with him and a pair of wire-cutters and pliers, so I could inflict the same damage on him that he inflicted on me. But, I do not want to kill him, nor do I want to see him die."

Flynt said Franklin had "targeted me because of a photo spread I ran in Hustler magazine featuring a black man and a white woman. He had bombed several synagogues... He hated blacks, he hated Jews."

The Missouri Supreme Court has ordered Franklin to be put to death by lethal injection on November 20.

"I have every reason to be overjoyed with this decision, but I am not," Flynt said.

"I have had many years in this wheelchair to think about this very topic.

"As I see it, the sole motivating factor behind the death penalty is vengeance, not justice, and I firmly believe that a government that forbids killing among its citizens should not be in the business of killing people itself."

Flynt has fought several prominent legal battles involving the First Amendment -- the right to free speech guaranteed in the US Constitution -- and has unsuccessfully run for public office.

He won a seminal free speech case in 1988 before the US Supreme Court, and was the subject of a 1996 biopic by director Milos Forman, "The People vs Larry Flynt," starring Woody Harrelson and Courtney Love.

Moto Maker now automating iCloud-to-Google switching

Moving from an iPhone to Moto X? Motorola's hoping to make things a lot easier

Switching between mobile platforms is never easy, but Motorola's hoping a new addition to its web-based Moto Maker service will make things a little less painful for iOS converts. According to a Google+ post by Motorola's Punit Soni, it's now possible to migrate your iCloud account over to Google as part of the Moto Maker customization process.

First, users enter their iCloud login details, then they're given an estimate of how long the conversion process will take. Then, after a successful conversion, they're linked to their new calendar and contacts on Google. The Moto X help page advises switchers to use Google's built-in tools to check for duplicates.

Many other manufacturers, including HTC, Sony and Samsung, have their own software-based solutions for porting over iOS users' stuff to their handsets, but this is the first time we're aware of that it's been done over the web. And it's especially slick that this can be done as part of the ordering process, so the new phone arrives pre-populated with the customer's stuff.

Soni says "there is a long way to go, but its a start."

Felony Charges For 2 In Suicide Of Bullied Girl

Police in Florida have arrested and charged two girls, a 14-year-old and a 12-year-old, with aggravated stalking in the case of a girl who committed last month.

Rebecca Sedwick, a 12-year-old seventh grader in Lakeland, jumped to her death from an abandoned silo after enduring bullying both online and face-to-face. According to police, the bullying consisted of Facebook messages, texts and confrontations at school, actions that they say contributed to Rebecca's suicide.

Though an affidavit said that the bullying occurred from Dec. 2012 to Feb. 2013, according to the New York Times, the girl's mother said it began long before then.

The arrest by the Polk County sheriff's office Monday was prompted by a Facebook comment allegedly posted by one of the girls that bullied Rebecca. It read: "Yes ik [I know] I bullied Rebecca nd she killed her self but IDGAF [I don't give a (expletive)]."

The New York Times reports:

"The Facebook post, Sheriff Grady Judd of Polk County said, was so offensive that he decided to move forward with the arrest immediately rather than continue to gather evidence. With a probable cause affidavit in hand, he sent his deputies Monday night to arrest two girls, calling them the "primary harassers." The first, a 14-year-old, is the one who posted the comment Saturday, he said. The second is her friend, and Rebecca's former best friend, a 12-year-old."

Sheriff Judd said the older girl "forced this arrest today," and that they couldn't just "leave her out there."

"Who else is she going to torment? Who else is she going to harass? Who is the next person she verbally abuses and attacks?" he said.

The Orlando Sentinel reports that after the arrests, the girls admitted the abuse. The 14-year-old is in the custody of the Department of Juvenile Justice until her next hearing; the 12-year-old is on house arrest.
